By booking through the Mamaya Villas website or via online booking services, including those offered through third-party online travel agencies (OTAs), you agree to comply with and be bound by the following Terms and Conditions. Please review them carefully before making a reservation.

1. Acceptance of Terms

By using our website or booking services, you acknowledge that you have read, understood, and agree to these Terms and Conditions. If you do not agree with any of these terms, please do not use our services.

2. Reservation Policies

2.1 Booking Confirmation

Reservations are confirmed upon receipt of a confirmation email, which outlines your booking details and serves as proof of reservation. Please ensure the email address provided is accurate and monitored.

2.2 Payment Terms

A valid credit card is required to secure your booking or bank transfer. Payment terms, including any required deposits, are specified at the time of booking. For reservations through OTAs, their specific payment terms apply.
The final amount received via bank transfer will account for any applicable bank fees, which will be charged to the guest.
Card payments are subject to a 3% fee, PayPal payments incur a 3.5% fee, while bank transfers are free of charge and eligible for a 3% discount.

All fees are already included in the final price. Please contact us to receive the 3% discount for payments made by bank transfer.

A 3% service charge will be applied to all orders as additional salary support for the employees of Mamaya Villas.

2.3 Deposit Requirements

  • For stays of 1 night, a deposit of 100% of the total stay is required to confirm the booking.
  • For stays longer than 1 night, a 50% deposit is required, with the remaining balance payable upon arrival.

2.4 Cancellation, No-Show, and Modification Policies

Refer to our Cancellation and Modification Policy for detailed terms. In the event of a no-show or early departure, the reservation is subject to a cancellation fee equivalent to the full stay. Reservation modifications are subject to availability and may incur additional charges.

3. Property Policies

3.1 Check-In and Check-Out

  • Check-in time: 2:00 PM. Early check-in requests are subject to availability and may incur additional charges (1000 Php/hours).
  • Check-out time: 12:00 PM. Late check-out requests are subject to availability and may incur additional charges (1000 Php/hours).

If you require an early check-in or late check-out, please contact the virtual office on whatapp one day prior, and we will do our best to accommodate your request.

3.2 Right to Refuse Service

Mamaya Villas El Nido is privately owned and operated. We reserve the right to refuse service to anyone for any reason that does not violate Philippine laws. Mamaya Villas El Nido has a zero tolerance policy and may refuse service or accommodation, or remove a person without refund, if they do not adhere to the reasonable standards and policies established by the Villas.

3.3 Grounds for Refusal or Eviction

Mamaya Villas El Nido reserves the right to refuse service or evict a guest if they:

  • Refuse or fail to pay for accommodations.
  • Are under the influence of alcohol, drugs, or any other intoxicating substance and act in a disorderly manner that disturbs the peace of other guests.
  • Are unable to properly supervise their children at all times.
  • Seek to use the villa for unlawful purposes.
  • Bring into the villas an unlawfully possessed firearm or any hazardous or toxic substance.
  • Destroy, damage, deface, or threaten harm to property or other guests.
  • Exceed the maximum allowable occupancy of rooms.

3.4 Child Policy

One child aged 0-7 years may stay free of charge if sharing an existing bed with parents. Breakfast is not included in this free stay arrangement.

3.5 Identification and Verification

A valid government-issued ID and the credit card used for booking must be presented at check-in.

Terms And Conditions

A security deposit of PHP 5,000 is mandatory and is payable upon check-in along with any remaining balance. This deposit may be used to cover incidental charges during your stay, with any unused amount refunded within 24 hours after check-out. In the event of damage or property loss, the matter will be reported to immigration authorities, and individuals may face travel restrictions until full compensation is settled.

4. Use of Facilities

4.1 General Rules

Guests are expected to adhere to Mamaya Villas’ rules and regulations. Any property damage or violation of rules may result in additional charges or termination of stay.

4.2 Pool and Recreational Areas

Use of pool and recreational areas is at guests’ own risk. Children must be supervised by an adult at all times.

4.3 No Smoking Policy

Mamaya Villas maintains a strict no-smoking policy in all rooms. Designated smoking areas are available.

4.4 Environmental Commitment

We encourage guests to support El Nido’s NO SINGLE-USE PLASTIC initiative to promote environmental sustainability.

5. Local Regulations and Policies

5.1 Attire and Conduct

Guests are encouraged to wear modest clothing in public areas, such as shirts, shorts, dresses, or other attire covering the torso when outside beach areas.

5.2 Smoking Restrictions

Smoking is prohibited in public areas except in designated zones, where cigarette waste can be properly disposed of.

6. Travel Insurance

Mamaya Villas highly recommends purchasing travel insurance to protect against unforeseen circumstances like illness, weather delays, or other disruptions to travel plans.

7. Limitation of Liability

Mamaya Villas, its management, and staff shall not be liable for any direct, indirect, incidental, or consequential damages related to your stay, including but not limited to damages for lost profits, data, or other intangible losses. Mamaya Villas is not responsible for additional expenses, delays, or inconveniences caused by circumstances outside its control, such as travel disruptions, political issues, or natural events.

8. Force Majeure

Mamaya Villas shall not be held liable for any failure to fulfill obligations due to circumstances beyond its control, such as natural disasters, war, or government actions.

9. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of the Republic of the Philippines. Any disputes arising from or related to these terms shall be resolved through amicable negotiation. If unresolved, the dispute will be subject to the exclusive jurisdiction of the courts in the Philippines.

10. Amendments

Mamaya Villas reserves the right to amend these Terms and Conditions at any time. Updates will be posted on our website, and continued use of our services constitutes acceptance of the revised terms.
